Terms of Use

These Terms of Use (the "Terms") are an agreement between you and CyberWave Technologies LLC, a California limited liability company ("we", "us"), and govern your use of MarketScale AI (the "Service"), provided on the web and as an iOS and macOS application. By using the Service you agree to these Terms.

The Service

MarketScale AI generates marketing strategy, ad copy, creative, and related assets from the inputs you provide. AI-generated output may contain errors; you are responsible for reviewing it before use and for ensuring your use complies with the policies of any advertising platform and with applicable law.

Subscriptions, free trial & billing

• Full access to the app is offered through auto-renewable subscriptions: MarketScale Pro Monthly at $9.99 per month or MarketScale Pro Annual at $79.99 per year(or the equivalent in your local currency as shown at purchase).
• New subscribers receive a 3-day free trial. Your subscription begins after the trial unless you cancel before it ends.
• Payment is charged to your Apple Account at confirmation of purchase. The subscription automatically renews at the then-current price unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription, and turn off auto-renewal, in your Apple Account settings after purchase. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
• Purchases are processed by Apple and are subject to Apple's applicable terms. Refunds are handled by Apple in accordance with App Store policies.

Acceptable use

You agree not to use the Service to generate unlawful, infringing, deceptive, or harmful content, and not to attempt to disrupt or gain unauthorized access to the Service.

Intellectual property

Subject to these Terms and your compliance with them, you own the campaign content you generate for your own marketing use. The Service, its software, and branding remain our property.

Disclaimer & limitation of liability

The Service is provided "as is" without warranties of any kind. We do not warrant that AI-generated marketing content will be accurate, effective, or produce any particular business outcome. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, and our total aggregate liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and allow 30 days to resolve the dispute informally. Either party may bring qualifying claims in small-claims court.
